1. What These Terms Cover

These Terms of Service ("Terms") govern your purchase and use of the digital products described below (collectively, the "Guide Bundle" or "Products"), sold by Birchwood Software LLC, d/b/a CoParentEvidence™ ("we," "us," "our"), through our checkout platform. By completing a purchase, you agree to be bound by these Terms.

The Guide Bundle currently consists of:

7 Days to a Paper Trail Your Attorney Will Actually Use (guide)
The Documentation Workbook (companion workbook)
The Documentation Tracker (spreadsheet template)
Choosing the Right Attorney for a High-Conflict Case (optional add-on guide, offered separately after checkout for $17)

These Terms apply only to these digital, one-time-purchase Products. If you separately subscribe to the CoParentEvidence web application, that subscription is governed by a different Terms of Service, available at coparentevidence.com/terms.

2. Eligibility

By purchasing, you represent that you are at least 18 years old and legally able to enter into a binding agreement, and that the payment and contact information you provide is accurate.

3. What You're Buying: Digital Delivery, No Ongoing Service

The Products are delivered as downloadable digital files (PDF and/or spreadsheet format) upon completed payment. There is no account, login, or ongoing service associated with this purchase — once delivered, the files are yours to keep and use as described in Section 4.

If we make minor corrections or updates to the Products after your purchase (e.g., fixing a typo or broken link), we may — but are not obligated to — provide you with the updated file at no additional cost. A substantially new or differently-named product is not covered by your original purchase.

4. Your License to Use the Products

4.1 Limited personal license. We grant you a limited, non-exclusive, non-transferable license to use the Products for your own personal documentation and record-keeping purposes.

4.2 What you may not do. You may not:

Share, distribute, resell, or post the Products (or any part of them) publicly, including on social media, file-sharing sites, or with people who have not purchased them
Use the Products' content to create a competing product or service
Remove or alter any copyright or trademark notices
Use the Products' content to train, fine-tune, or otherwise develop any artificial intelligence or machine learning model

4.3 Ownership. All content in the Products — text, design, structure, and branding — is protected by copyright and trademark law. This content is owned by Birchwood Holdings LLC and used and sold by Birchwood Software LLC under an exclusive license. Your purchase gives you a limited license to use the files as described above, not ownership of the underlying content.

5. Not Legal Advice

This is important, so we're saying it plainly and up front, not burying it in fine print.

The Guide Bundle is an educational documentation tool. It is not legal advice, and using it does not create an attorney-client relationship of any kind. We are not a law firm. Nothing in the Products should be relied on as a substitute for advice from a licensed attorney in your jurisdiction about your specific situation. Family law, evidence rules, and custody procedures vary significantly by state and by case — you should consult a qualified attorney before making decisions about your legal matter.

We make no representation that following the guidance in these Products will result in any particular legal outcome, or that any record, summary, or document you create using them will be accepted or admissible in any court proceeding.

6. Payment

All payments are processed through our third-party payment processors (Stripe & Paypal). By purchasing, you agree to Stripe and Paypal's terms of service in addition to these Terms. Prices are listed in U.S. Dollars. We may change prices for future purchases at any time; price changes do not affect a purchase you've already completed.

7. Refund Policy

All sales are final. Because these are instantly-delivered digital files, we do not offer refunds once a purchase is complete, except where required by law.

If you experience a technical issue and cannot access or download a Product you purchased, contact us at hello@coparentevidence.com so we can resolve the access issue.

8. No Warranties

The Products are provided "as is." We do not guarantee that the Products are error-free, that they will meet your specific needs, or that using them will produce any particular result in a legal matter. To the fullest extent permitted by law, we disclaim all other warranties, express or implied.

9. Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising from your purchase or use of the Products will not exceed the amount you paid for the Product giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including any outcome related to a legal proceeding, custody matter, or decision you made based on the Products.

10. Indemnification

You agree to indemnify and hold harmless Birchwood Software LLC, its owners, and contractors from any claims arising out of your misuse of the Products or your violation of these Terms.

11. Third-Party Services

Your purchase is processed through Stripe or Paypal and may be delivered via our email/checkout platform (systeme.io). We are not responsible for outages, errors, or policy changes on the part of these third-party services.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Effective Date" above. Continued use of the Products after a change constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Virginia, without regard to conflict-of-law principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in Fairfax County, Virginia.

14. Entire Agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Guide Bundle and supersede any prior discussions or representations.
